If a business partner and I own a trademark, and the partner quits the business, can I still use the trademark?

I realize there is a form to remove the other person. However getting them to sign would be tough. Are they entitled to any of my profits, or are they only allowed to use the name to sell materials? The two trademarks are for sound recordings, and musical performance/publishing.
